Introduction

The Legal Services Department serves as the central legal advisory arm of the Malawi Electoral Commission (MEC). It is responsible for ensuring that the Commission operates within the framework of the Constitution, the Malawi Electoral Commission Act, and all other relevant laws. The department provides comprehensive legal support to the Commission in its policy formulation, decision-making, and operational activities, thereby safeguarding the Commission’s integrity and upholding the rule of law in all electoral processes.

The department’s work is essential in maintaining the Commission’s credibility and ensuring that all its actions are transparent, legally defensible, and compliant with statutory obligations. Through advisory, policy, and litigation functions, the Legal Services Department strengthens the Commission’s institutional capacity to deliver free, fair, and credible elections.

Roles and Functions

The Legal Services Department performs the following functions:

  • Legal Advisory:

Providing legal advice to the Commission on procedural and substantive matters relating to electoral law, governance, and statutory compliance.

  • Policy and Regulatory Development:

Formulating and reviewing policies, regulations, and procedure manuals to ensure that all operations of the Commission align with electoral laws and good governance practices.

  • Compliance Monitoring:

Monitoring the Commission’s activities to ensure compliance with statutory and regulatory requirements and advising accordingly on legal risks or irregularities.

  • Legal Drafting:

Preparing legal briefs for the Commission’s consideration, drafting statutory instruments, and preparing Gazette Notices as required by law.

  • Coordination with the Ministry of Justice and Attorney General’s Office:

Working closely with the Ministry of Justice and Office of the Attorney General on matters of public interest and on all legal issues that require government coordination or legal opinion.

  • Litigation Management:

Liaising with external legal firms engaged by the Commission, monitoring their performance, and representing the Commission in court on litigation matters when necessary.

  • Commission Support:

Preparing agendas and documentation for Commission meetings, ensuring that members are provided with all legal briefs, records, and relevant background information to support decision-making.

  • Legal Research and Documentation:

Conducting background legal research to guide the Commission’s policy direction and drafting official responses to external correspondence as directed by the Chief Elections Officer or the Commission.

  • Legislative Review:

Reviewing legal implications of existing laws and policies, and recommending amendments or new legislation to enhance the legal framework governing elections.

  • Electoral Complaints and Dispute Resolution:

Facilitating the handling and determination of electoral complaints at all stages of the electoral process, ensuring due process and adherence to legal principles.

  • Multi-Party Liaison Committees (MPLCs):

Coordinating the functions of MPLCs at district and council levels to promote dialogue, conflict resolution, and cooperation among political parties.

  • Company Secretarial Functions:

Performing company secretarial duties as designated under the Malawi Electoral Commission Act, including maintaining records, minutes, and resolutions of the Commission.

  • Results Documentation:

Drafting summaries of results for all elections to facilitate proper documentation, publication, and record-keeping.

Position in the Strategic Plan (2023–2028)

The Legal Services Department’s mandate is embedded under Pillar 1: Governance and Legal Frameworks of the 2023–2028 MEC Strategic Plan. Within this framework, the department contributes to:

  • Strengthening legal compliance and accountability within the Commission.
  • Enhancing the legal and policy environment for electoral management.
  • Promoting timely resolution of electoral disputes.
  • Supporting institutional reforms and modernization of electoral laws.
